Terms of Use

These terms govern the nomination and participation process for the Excellence in Workplace Wellbeing Awards 2025 (“the Awards”). Please read them carefully. By submitting a nomination, you agree to be legally bound by these rules.

1. Introduction – The Well Crowd Platform  

Welcome to The Well Crowd, a curated and independent digital platform operated by TheWellCrowd Ltd (Company Number 15998990), registered in the United Kingdom (the Platform).  

The Well Crowd provides a neutral, UK-based discovery and information platform connecting workplace wellbeing service providers with businesses. We do not sell wellbeing services ourselves and are not a party to any contractual arrangement between Clients and Providers. The Platform hosts curated listings, editorial content, research insights, awards, networking event information, and the promotion of both internal and external industry initiatives. 

The Platform is intended to service workplace wellbeing service providers and their business clients or potential clients only, and not the general public or individual consumers of wellbeing services. 

2. Terms of Use

These Terms of Use (Terms) set out the rules and responsibilities governing your access to and use of our Platform, including our website, services, content, and features.  

By visiting the Platform, registering as a user, listing services, or accessing any of our content, you confirm (1) that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies which we may publish online from time to time, and (2) that you are either a workplace wellbeing service provider or a business client or potential client of workplace wellbeing service providers, and not a consumer or member of the general public.

4. User Roles and Access

Users may interact with the Platform in the following ways: 

  • Clients: Organisations, HR professionals, wellbeing leads, or business contacts seeking to discover, compare, and connect with Providers, who have registered to access our Provider directory the List, save favourites, build shortlists, and access other user features.
  • Providers: Individuals or organisations who register to list and promote their workplace wellbeing services. Providers will be able to edit their entries on the List via their user dashboard. 
  • Subscribers: Anyone who has opted in to receive our updates, newsletters, or promotions via email or other communication methods. 
  • Visitors: Unregistered users who may browse public content, learn more about the Platform, and register as a subscriber to receive newsletters and other content. 

Terms Applicable to all Users

As well as the sections below, please also see our “General Terms” section at the end of these Terms. General Terms apply to all users. Please also see the “Definitions” section at the end of these Terms, which explains some of the wording or phrases used. 

5. Acceptable Use and Community Standards

All users agree to engage respectfully and professionally on the Platform, in line with our values.

All users must:

  • Engage respectfully and constructively 
  • Avoid discriminatory, defamatory, or harassing conduct 
  • Comply with applicable laws 
  • Not misuse Platform features, impersonate others, or submit false or misleading information

All users who register whether as Clients, Providers or Subscribers, must submit accurate information during the registration process. Anyone who chooses to register in whichever of these categories must be a business user and not a consumer or member of the general public. 

We reserve the right to suspend or terminate access for users who breach these standards or otherwise misuse the Platform.

6. Advertising, Promotions and Editorial Independence

Some listings and articles on the Platform are marked as “Sponsored,” “Featured,” or “Affiliate.” These may be paid promotional placements or generate commission through affiliate links. All such content is clearly disclosed in line with ASA guidelines. 

Editorial independence is important to us. We strive to ensure content reflects accurate, useful information, whether or not is has been created in partnership with Providers or advertisers.

7. Platform Role and Editorial Disclaimer

The Well Crowd acts solely as a discovery and content platform. We do not act as an agent, broker, or employer of any listed Provider. The inclusion of any Provider, service, or editorial content on the Platform does not constitute an endorsement, recommendation, or assurance of suitability. Opinions expressed in editorial content are those of the writer and may not be ours. 

All content, including listings, articles, news, The Edit and other editorial insights, is provided for general information purposes only. It does not constitute professional advice of any kind. Users should always consider whether to seek their own independent advice before making decisions or entering into any agreement with a Provider.

Terms Applicable to Providers

8. Listing Packages and Subscriptions

We offer four listing tiers for Providers:

  • Discover: A free basic listing with limited features, no review functionality or Verified Badge 
  • Ignite: A paid listing with a Verified badge, access to reviews, and enhanced platform visibility 
  • Scale: A premium package that includes Verified or Verified Plus+ status (which is subject to additional checks), advanced visibility, access to reviews, editorial access, and promotional features 
  • Ultimate: Our highest-tier package with all features of Scale, bespoke promotional support, and the option of Verified Plus+ status

Details of features, pricing, and badge criteria are available in the List / Membership section of the website. All prices are stated clearly and exclude VAT where applicable. 

Some Providers may be awarded Top Rated status based on their review ratings.

9. Payment Terms

All payments are securely processed using Stripe Connect. By making a payment through the Platform, you agree to Stripe’s Terms of Service and Privacy Policy. The Well Crowd does not store or process your card details directly and is not responsible for Stripe Connect or any of its services. 

Paid plans are billed on a recurring monthly or annual basis depending on the selected option. You may downgrade your package at any time, with the change taking effect at the end of the current billing cycle. We do not provide pro-rata refunds for unused time.

Chargebacks or disputed payments may result in temporary or permanent suspension of your listing or access to features. We reserve the right to provide Stripe with supporting information to resolve any such disputes. 

10. Provider Responsibilities

Providers must ensure that all information in their listings is accurate, up to date, and not misleading. Providers confirm that they are qualified to offer the services they promote, and that they comply at all times with all relevant professional standards, laws and codes of conduct including CQC registration where applicable, and carry appropriate insurance relative to the services they offer and the scale of their business. 

Failure to uphold these obligations may result in the suspension or removal of a listing, without refund. 

Providers will have access to their own dashboard which they can access by logging in. Providers must maintain appropriate security for their own login details, and are solely responsible for their users on the Platform and for ensuring that their users comply with these Terms.

Terms Applicable to Clients

11. Reviews and User-Generated Content

Only verified Clients of paid-tier Providers (Ignite, Scale, Enterprise) may leave reviews on the Platform. Reviews must reflect genuine experiences, be factual and accurate, and be respectful in tone. The Well Crowd reserves the right to moderate or remove reviews including reviews that are or appear to be abusive, defamatory or untrue. 

By submitting reviews, feedback, or other content to the Platform, you grant The Well Crowd a non-exclusive, worldwide, perpetual, royalty-free licence to use, adapt, and publish that content in connection with the Platform and its promotion.

General Terms Relating to all Users

12. Platform Services and Hosting

The Well Crowd platform is hosted in the United Kingdom. To operate effectively, we rely on a range of trusted third-party service providers who support areas such as secure payment processing, customer communication, data collection, email delivery, content management, analytics, and operational systems. These services are integrated into the platform under appropriate contractual arrangements. 

Whenever we process your data, it is handled in accordance with our Privacy Policy and applicable legal safeguards. 

13. Conditions for Use of the Platform

Users of the Platform may not: 

  • copy, modify, translate, or create derivative works of the Platform;  
  • reverse engineer, decompile or otherwise attempt to reconstruct or discover any source code or algorithms;  
  • attempt to transfer membership, licence or otherwise use the Platform on behalf of any third party or allow any third party to access the Platform using the user’s credentials; 
  • attempt to disrupt the integrity or performance of the Platform; 
  • use the Platform in any manner that breaches these Terms, infringes on any third-party rights or any laws; 
  • use their access to the Platform to build a competitive product or services; or 
  • copy any content, features, get-up or look of the Platform. 

Users are responsible for maintaining confidentiality of their login credentials and must not reveal those credentials to any third party.

14. Legal Limitations and Liability

We do not guarantee that the Platform, listings, or any Provider service will be uninterrupted, accurate, or error-free. We will use commercially reasonable endeavours to provide access to the Platform at all times but this is subject to any scheduled or other maintenance of which we will provide notice wherever reasonably possible, and we cannot guarantee that there will be no interruptions to access including for causes beyond our control such as internet outages. 

Your use of the Platform is at your own risk. Any relationship between a Client and Provider is a private contract between those parties. We are not responsible for the outcome of any such engagement or interaction. 

To the maximum extent permitted by law, The Well Crowd excludes liability for any loss of use or interruption of business, loss of actual or anticipated profits, loss of opportunity, goodwill or reputation, loss of, damage to or corruption of data, or any indirect, special, incidental, secondary or consequential loss or damage of any kind regardless of the form of act or omission, whether in contract, tort, strict liability or otherwise, which arises under any law and relates to your use, or inability to use the Platform or any related services. Our total liability to any user shall be limited to £50,000. 

Nothing in these Terms limits liability for fraud, or for death or personal injury caused by our negligence.

15. Suspension and Termination

We may suspend or permanently disable your account or access to the Platform if you breach these Terms, including in the case of Providers, failure to pay fees, or if required by law or regulation, or if we consider in our sole discretion that your continued access to the Platform may damage our, or our other users’ reputations. You may close your account at any time by contacting us, provided that your payment obligations, if any, will continue until the end of your current billing cycle. 

Termination of these Terms will not affect any rights which have accrued prior to the date of termination, including in the case of Providers, our right to payment of any fees through the end of their current billing cycle.

16. Other

Information which a reasonable businessperson would regard as confidential to the discloser must be treated by the recipient as Confidential Information under these Terms. Confidential Information will remain the property of the discloser. The recipient will use such Confidential Information only for the purposes of these Terms, will use a reasonable standard of care in maintaining its confidentiality, and will not disclose it to any third party without the discloser’s consent, unless permitted by these Terms required by law to do so.  

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will, to the extent required, be deemed not to form part of these Terms but will apply with the minimum change required to render it valid, legal and enforceable, and the validity and enforceability of the remainder of these Terms will not be affected.

We have the right to make changes to these Terms from time to time. We will contact registered users to notify them of any such change. Continued use of the Platform after such notification is deemed to be consent to such change. 

All legal notices must be sent by email, in the case of a user to the email address used for registration, and in the case of The Well Crowd to hello@thewellcrowd.com. Notices will be deemed when sent, if sent during the business hours of the recipient, and if not, at the start of the next business hours of the recipient. 

If our performance of our obligations under these Terms is prevented, restricted or interfered with by a force majeure event, we will not be in breach of these Terms. In that event we will use commercial reasonable endeavours to resume performance as soon as reasonably possible. 

If we become the subject of a claim, become involved in a legal proceeding, or suffer any economic loss or damage as a result of your breach of these Terms, you will be responsible for compensating us for the full amount of our loss, as well as any reasonable amounts we incur in lawyers’ fees, expenses and court costs, except in the case and to the extent that we have contributed to the loss or damage. 

A failure or delay in exercising any right or remedy provided under these Terms or by law will not constitute a waiver of that or any other right or remedy, nor will it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of any right or remedy will preclude or restrict the further exercise of that or any other right or remedy.

These Terms, together with (in the case of Providers and Clients) the application form and any documents referred to in these Terms, constitute the entire agreement between the user and The Well Crowd and supersede and extinguishes any previous drafts, agreements, arrangements and understandings between the user and ourselves, whether written or oral, relating to their subject matter. 

No person other than a user or The Well Crowd will have any rights to enforce any of these Terms. 

These Terms and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims) will be governed by and construed in accordance with the laws of England. In the event of a dispute arising out of or relating to these Terms, the courts of England will have exclusive jurisdiction.

17. Definitions

The List: The Well Crowd’s workplace wellbeing provider directory, accessed via the Platform and requiring user registration. Used by businesses, HR or People Leaders seeking workplace wellbeing services and providers. 

The Edit: The Well Crowd’s curated weekly newsletter, bringing you the latest insights, trends, and trusted updates in workplace wellbeing. 

Sponsored: A paid listing with visibility benefits such as priority in search results. Available for Ignite, Scale, and Ultimate tiers. 

Verified: A standard vetting mark available for Ignite, Scale, and Ultimate Providers, indicating completion of initial checks. 

Verified Plus+: An extended vetting mark available to Scale and Ultimate Providers, signifying deeper due diligence. 

Top Rated: Awarded to Providers with four or more verified reviews and an average rating of three stars or higher. 

Reviews: Client-submitted feedback visible only on Ignite, Scale, and Ultimate listings. 

Discover: The free basic listing package with limited functionality.

Ignite: A paid package offering the Verified badge and access to Platform tools and reviews. 

Scale: A premium listing package including Verified or Verified Plus+, editorial promotion, and enhanced visibility. 

Ultimate: A premium tier offering all features, advanced vetting, and custom promotional campaigns. 

TWC Approval Badge:  TWC Approval Badge is encouraged for all tiers except Discover. Discover providers must upgrade to use this trusted mark of credibility. 

Featured: A promotional or editorial highlight, whether paid for or organic, used to boost a Provider’s exposure.
